MOHAWK VALLEY ELITE — LIABILITY WAIVER & RELEASE
Basketball Skills Training | Herkimer County Community College
By signing below, I acknowledge and agree to the following on behalf of myself and/or my child (the "Participant") named on this form:
- Assumption of Risk. I understand that basketball and athletic training involve inherent risks, including but not limited to physical contact, falls, collisions, strains, sprains, fractures, concussions, and other serious injury, illness, or in rare cases death. I understand these risks cannot be eliminated regardless of the care taken. I voluntarily choose for the Participant to take part with full knowledge of these risks.
- Medical Fitness. I confirm the Participant is physically fit and has no condition that would prevent safe participation. I authorize Mohawk Valley Elite and its staff to seek emergency medical treatment for the Participant if needed, and I accept responsibility for any resulting costs.
- Release of Liability. I release, waive, and discharge Mohawk Valley Elite, its LLC, directors, coaches, trainers, volunteers, and employees, as well as Herkimer County Community College and its staff and agents (collectively, the "Released Parties"), from any and all claims, liabilities, or demands arising from the Participant's involvement in the training, including those caused by the ordinary negligence of the Released Parties, to the fullest extent permitted by law.
- Indemnification. I agree to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of the Participant arising from participation, except where prohibited by law.
- Photo / Media Release. I grant Mohawk Valley Elite permission to use photographs and video of the Participant taken during training for promotional and social media purposes without compensation. (Use the opt-out box below to decline.)
- Code of Conduct. I agree the Participant will follow all rules and instructions from coaches and HCCC facility staff, and I understand they may be removed from training for unsafe or disruptive behavior without refund.
- Acknowledgment. I have read this waiver, understand it is a release of legal rights, and sign it freely. If signing as a parent or guardian, I confirm I have legal authority to do so on behalf of the minor Participant.
